Jared Marx is an experienced litigator focused on helping companies and individuals resolve complex cases, particularly in the areas of telecommunications and legal ethics. He serves as Co-Chair of the firm’s Litigation & Investigations practice.
Telecommunications Litigation
For more than a decade, Jared has helped communications companies address critical issues in court and before regulators, including issues related to the Universal Service Fund, intercarrier tariff and compensation disputes, and the False Claims Act. His experience includes having:
- Represented a major telecommunications company in several intercarrier compensation disputes in federal trial and appellate courts;
- Defended a major telecommunications company in federal False Claims Act litigation related to USF and 911 fee obligations;
- Defended companies in precedent-setting FCC Enforcement Bureau actions relating to the Rural Healthcare program, rural call completion obligations, number porting obligations, and other matters;
- Challenged FCC orders in the D.C. Circuit, including orders related to inmate calling rates set using arbitrary and capricious standards; and
- Defended providers in Telephone Consumer Protection Act (TCPA) lawsuits.
Legal Ethics
Jared represents individuals and law firms in high-stakes professional responsibility proceedings. He has represented AMLaw 100 firms in several high-profile and high-dollar value disputes, and successfully represented individuals in disciplinary proceedings before state and federal bar organizations.
Government and Internal Investigations
Jared advises companies and individuals responding to government investigations involving the Department of Justice and the Federal Communications Commission. Jared also helps companies conduct internal investigations, including investigations that involve serious allegations of fraud and broad geographical scope. His work has led to successful self-reporting and settlement with the Department of Justice and the FCC.
Jared has argued in the Federal Courts of Appeals for the D.C., 5th, and 8th Circuits, and has represented companies, individuals, and sovereign nations in numerous successful appeals. He regularly authors federal and state appellate briefs, including briefs filed in the United States Supreme Court.
