Marx recently contributed an article to Law360 titled “How The 5th, DC Circuits Agreed On FCC Forfeiture Orders,” examining the recent circuit split between the U.S. Courts of Appeals for the Fifth and D.C. Circuits over whether the Federal Communications Commission’s enforcement process satisfies the constitutional right to a jury trial.

Jared explains that despite their differences, both courts agreed on an important point: untested FCC enforcement orders cannot be used against a party until affirmed by a neutral third party or conceded. He notes that this development marks a critical shift for parties facing FCC enforcement actions.
