At HWG LLP, we take privacy and data protection seriously. On this page, we’ll give you the information about our privacy and data protection practices for the personal information that we gather from or about visitors to our website, our business contacts, and other individuals, other than HWG employees. When we refer to “personal information,” we mean any information that relates to an identified or reasonably identifiable individual or household.

How We Collect and Use Personal Information

 

Representation-Related Information

We may obtain personal information from our or on behalf of our clients in connection with our representation of them. For example, our clients may provide us with files containing personal information pertaining to their customers or business contacts. We use this information in connection with providing legal services on behalf of the relevant client, in accordance with the relevant client’s instructions, applicable law, and the applicable rules of professional conduct.

If you believe HWG may have been provided with your personal information in connection with its representation of a client, please contact that individual or company directly for more information related to their data protection practices.

Website Visitors

We may collect the following types of personal information from and about individuals who visit any HWG website:

      • Technical information about how you’re accessing our website, including information about your internet connection and the device you are on,
      • Information about how you use the website and your website preferences,
      • General information about where you are located, including country and region,
      • Demographic information and information about your internet usage, and

      • Note that information you send to us through any web form on the HWG website is not encrypted and could be intercepted by third parties. Do not send us confidential information through the HWG website.

We may collect personal information from or about website visitors in the following ways:

We collect and further process personal information pertaining to website visitors to provide you with information that you have requested and for other legitimate business interests, including to improve our website, to communicate with you about HWG or legal topics, and for marketing purposes. When you voluntarily send us personal information, we also collect and further process this information based on your consent.

Business Contacts

We may also collect personal information from clients, potential clients, opposing counsel, and other business contacts. This information may include:

      • Legal topics that may be of interest to you,
      • Information about your attendance at HWG events,

We collect and further process personal information pertaining to business contacts to provide you with information that you have requested and for other legitimate business interests, including to communicate with you in connection with our representation of our clients and to send you HWG newsletters, information about HWG events, and other HWG-related updates. When you voluntarily send us personal information, we also collect and further process this information based on your consent.

Job Candidates

When considering a candidate for a job at HWG, we collect contact information, employment history, criminal history, credit history, and other information bearing on fitness for a particular position with HWG.

We may collect personal information from or about job candidates in the following ways:

      • From third parties, including recruiters,
      • From participants in events that we host, sponsor, or attend, including automated collection from online participants, and
      • Directly from you when you provide it to us.

We collect personal information from job candidates for the purpose of potential entry into a contract to which you would be a party, i.e. an employment contract; legitimate interests, such as soliciting applications for employment, providing legal and HWG updates, and evaluating and improving our hiring practices; and consent, when you provide personal information to us directly or through an authorized representative.

Disclosure of Personal Information

We may disclose any of the types of personal information described above to:

• • • • Service providers who process personal information on HWG’s behalf, in accordance with the limits that apply to HWG under this privacy notice,
      • Affiliates, successors, or their agents in connection with a restructuring, dissolution, or other sale or transfer of some or all HWG assets,
      • Third parties (which, for the purpose of this policy, excludes service providers, affiliates, successors, and their agents):
      • Where required by law or applicable rules of professional conduct,
      • In connection with fulfilling a request you made, or
      • In connection with protecting the rights or property of HWG.

We may also disclose or allow our service providers to collect personal information from visitors to an HWG website, recipients of HWG communications, job candidates, and participants in HWG-related events, including webinars. These third parties include companies that offer website analytics and event-hosting companies. Notice for California Residents

This chart provides an overview of the categories of personal information that HWG has collected, used, and disclosed in its capacity as a “business,” as defined in the California Consumer Protection Act (CCPA), during the past 12 months.

We may retain personal information for as long as reasonably necessary to fulfill the purposes described in the chart.

In the past 12 months, HWG has not “sold” or “shared” personal information with “third parties,” as such terms are defined in the CCPA. HWG does not knowingly “sell” or “share” personal information relating to children under the age of 16.

Children’s Privacy

Unsubscribing from HWG Communications

From time to time, we may contact you with information about laws, recent developments, and HWG that may be of interest to you. You can unsubscribe from future communications from HWG at any time by following the directions contained in the communication you received or by emailing your request to dpo@hwglaw.com.

Do Not Track and Universal Opt-Outs

HWG’s website is not currently configured to accept browsers’ “Do Not Track” signals, as no industry-wide standard for handling them has been adopted. HWG’s website does not provide a universal opt-out from the “sale” or “sharing” of personal information, as such terms are defined in the CCPA, as HWG does not engage in such sale or sharing.

Requests Pertaining to Representation-Related Information

If you believe HWG may have been provided with your personal information in connection with its representation of a client, please contact that individual or company directly with any requests related to your personal information.

Other Requests to Exercise Your Privacy Rights

We accept the following types of requests related to your privacy rights, with respect to personal information that HWG has collected from or about you in its capacity as a “business,” as that term is defined in the CCPA, or a “data controller,” as that term is defined in the Colorado Privacy Act, Virginia Consumer Data Protection Act, or other applicable data protection law:

      • Information about HWG’s processing of of your personal information,
      • Erasure of your personal information,
      • Correction of your personal information, or
      • A copy of your personal information, or
      • A copy of your personal information in a portable form.

If you reside in California, Colorado, or Virginia, you have certain legal rights with respect to other personal information. If you are subject to the protection of European Union, United Kingdom, Swiss, or other non-U.S. law, you may have similar legal rights. Your legal rights may be subject to certain exceptions.

You may still submit a request related to your personal information, even if you are not entitled to do so by applicable law. HWG reserves the right to evaluate and grant or deny such requests in its sole discretion.

We may require you to verify your identity before honoring your request. If your request is submitted by your authorized agent, authorized agent must present a signed, written authorization to act on your behalf.

We will respond to your request as soon as possible, even if we are unable to grant your request.

We do not discriminate or retaliate against you for exercising your privacy rights.

Changes to This Privacy Notice

HWG will notify you of any changes to this privacy notice by posting the updated notice on this page with its effective date. If the change is material, we will take reasonable steps to notify you in advance where required by applicable law.

A cookie is a small text file that is sent by a website to your computer or mobile device when you visit our website. We use cookies to help make our website work well and make your visits to our website more efficient. You can turn off such functionality-enhancing cookies by disabling cookies in your browser settings. If you do so, however, some parts of our website might not work on your device.
