Thomas B. Mason and Amy E. Richardson recently published a Law360 article titled “Key Ethical Issues For Gov’t Attys Moving To Private Practice,” describing some of the key ethical considerations from the Rules of Professional Conduct and the Ethics in Government Act for government employees transitioning to the private sector.

Tom and Amy examined the complexity of ethical issues government employees will face in their transition, including how personal and substantial participation affects their job search and post-employment restrictions, restrictions posed by the Ethics in Government Act, how the Biden Ethics Pledge impacts government employees, navigating confidentiality and imputation rules, as well as notable exceptions and waivers. Being aware of these rules will help government employees avoid any violations and stay aligned with ethical principles in their move to private practice.
