On May 30, Amy Richardson and Deepika Ravi presented the CLE program “Avoiding Privilege Pitfalls: Ethical Issues for In-House Counsel to the D.C. Bar. This program explored a critical question for protecting in-house attorneys’ communications with their clients: when is an in-house lawyer’s “dual-purpose” communication—containing both legal and non-legal advice—protected by attorney-client privilege? Using court opinions to guide a case-study based discussion of the rules, this program explored trends in privilege decisions relating to in-house counsel roles, and offered best practices to protect the attorney-client privilege.
