Jason E. Neal recently published the Law360 article, “Questions Remain After Justices’ Narrow E-Rate FCA Ruling,” analyzing questions raised by the Supreme Court’s decision in Wisconsin Bell, Inc. v. United States ex rel. Health and how this ruling might impact future False Claims Act (FCA) cases.

The article summarizes the Federal Communications Commission’s (FCC) Universal Service Fund, the central question in Wisconsin Bell, theories presented to the Court, and the Court’s decision. Jason addresses questions about traceability and damages in relation to FCA claims and the constitutionality of certain lawsuits brought by private parties in the Government’s name that remain unanswered by the Court’s decision, but which may be revisited in future cases.

Jason focuses his practice on telecommunications and appellate litigation. He represents clients before the FCC and federal appeals courts and counsels clients on regulatory issues in telecommunications transactions.
