Thomas Mason presented “Tri-State Ethics Confusion: Differences Among the District of Columbia, Maryland, and Virginia Rules” at the D.C. Bar.
This course provides the practicing attorney with an overview of the major differences among the District of Columbia, Maryland, and Virginia Rules of Professional Conduct. Attendees will learn how these sets of rules differ in the areas of fees, confidentiality, conflicts, conduct of litigation, client funds, contacts with third parties, advertising, and solicitation of clients. The course also addresses conflict of laws issues aimed at determining which jurisdiction’s rules might apply to a particular lawyer or scenario. Faculty will discuss steps that a lawyer can take to attempt to comply with all applicable rules, even when they differ. The program uses hypotheticals and practical examples to illustrate the application of the ethics rules.
